Judicial review
The United States Court of Appeals for Veterans Claims is the exclusive venue for judicial review of final Board of Veterans’ Appeals decisions. When the Board denies a claim, skips evidence, or applies the wrong legal standard, the Court is often the next step.
A CAVC appeal is not another round of the same VA process. It is an independent review of whether the Board’s decision can stand.
Why the Court
Veterans and surviving dependents do not pay the firm’s CAVC fees. Under the Equal Access to Justice Act, VA may cover attorney fees when the veteran prevails.
CAVC judges are independent of VA. That review is the check on Board of Veterans’ Appeals decisions that misapply the law or ignore the record.
Court review is often the fastest way to force a clear ruling after a Board decision that does not explain itself or apply the right legal standard.
A favorable CAVC decision tells the Board what it must fix. That can mean a new decision, missing development, or a grant that VA previously refused.
